State Sen. Jeff Denham, who represents San Benito County, signed on Thursday as a co-author to the Assembly Concurrent Resolution 115, according to a press release.
The ACR 115 recognizes the institution of homeschooling in California. The resolution is requesting that the California Supreme Court reverse the opinion of the California Court of Appeal for the second Appellate District in Los Angeles.
The California Appellate Court decided that anyone who home schools children needs to have a teaching credential.
The author of the ACR 115 is Assemblyman Joel Anderson, R-El Cajon.
In the L.A. court case, there was an attempt to force two of the couple's kids to attend either public or private school. With California law requiring that minors enroll in one or the other, or at least get tutored by a credentialed teacher, the 2nd District Court of Appeal found the family didn't meet the exemption criteria.
The opinion then included a stark interpretation that parents lack a constitutional right to home school their children.
